Type and Method of Service Provision

2.1 The operator is a commercial company that operates a sports and relaxation facility – 365Fit&Co. The premises of 365Fit&Co are located in the multifunctional complex GALLERIA EUROVEA, Pribinova 8, Bratislava. The goal and purpose of 365 Fit&Co are the sports activities and regeneration of its members. A member of 365Fit&Co is a natural or legal person who has signed a membership agreement or purchased a membership. The operator provides services related to a healthy lifestyle, especially services: Fitness&Cardio, Body&Mind, Wellness, massages, and other services within physical culture.

2.2 365Fit&Co is positioned as a club for sports, relaxation, and a healthy lifestyle for adults, not as a youth club or a club for children.

2.3 The method of service provision refers to enabling members and visitors/clients to use 365Fit&Co services based on the proper payment of membership in one of the forms specified in Article VII of this Operational Rules. Entry into the 365 Fit&Co facility is not allowed if there is a risk of exceeding the established capacity (the capacity is determined by the operator). For the purposes of these Operational Rules, a client is defined as a natural or legal person who obtains services from the operator in accordance with these Operational Rules.

Article III

Operating Conditions and Health Protection Principles for Visitors/Members and Employees of 365 Fit&Co

3.1 The premises of 365Fit&Co are divided into individual operations: Fitness&Cardio, Body&Mind, Wellness, (hereinafter “Operations”). The operator maintains the areas of individual Operations in cleanliness and order during the provision of services in accordance with Article IX.

3.2 When using tools and items intended for activities mentioned in Article II, members are required to follow the manufacturer’s instructions for individual devices and the instructions of responsible persons at 365Fit&Co to avoid endangering their health or damaging the property of the operator and others. Ventilation, heating, and lighting of the facility are provided by the operator. First aid kits located on the premises are equipped with basic medical supplies and are regularly checked.

3.3 Notices of smoking prohibition and the prohibition of open flames are posted in a visible place.

3.4 Outdoor terrace hot tubs at 365 Fit&Co fall into the category of artificial swimming pools according to Decree No. 308/2012 Coll. and meet all the operating conditions for such types of pools. Based on this, swimming areas comply with the mentioned decree in terms of access, as well as hygienic and technical requirements:

a. Their capacity is 12 people, and operation is seasonal.

b. Current information on water temperature in individual pools and air temperature is provided daily in a visible place. The average temperature of outdoor hot tubs is 35 degrees Celsius.

c. Cleaning and disinfection of operational areas, premises, equipment, and sports aids are performed by qualified personnel daily.

d. During pool operation, continuous water recirculation and disinfection are ensured.

e. Due to the volume of the hot tubs up to 10 m3 and a separate recirculation system, draining the entire volume of water is ensured at least once a month.

f. After draining, the pool, including technical equipment in contact with water, is mechanically cleaned, disinfected, and refilled with water complying with the requirements of Attachment 3 to the mentioned decree.

g. The operator keeps proper records of pool operation and, in accordance with the decree, conducts daily measurements of water temperature, water reactions, redox potential, values of free and bound chlorine, and water transparency.

h. In addition, the operator conducts monthly measurements of the following water quality indicators: Escherichia coli, intestinal enterococci, Pseudomonas aeruginosa, Staphylococcus aureus, cultivable organisms at 36 ± 1°C, producers, consumers, chemical oxygen demand, manganese, copper, legionella species, ozone, and total organic carbon.

i. Pool maintenance and cleaning are performed by a certified technician who holds a certificate of professional competence.

j. Visitors are required to adhere to behavioral principles: shower before entering the pool, not visit the pool in case of any communicable or skin disease, adhere to the pool’s capacity, and follow the staff’s instructions.

k. The use of sports aids in the pools is not allowed.

3.5. Wellness Area with Sauna

The wellness areas with saunas meet all the operating conditions for facilities caring for the human body in accordance with Decree No. 554/2007 Coll. The operator ensures adequate maintenance of these facilities in accordance with the decree and, at the same time, sets the following principles of behavior for visitors in the sauna and cooling pool:

a. The sauna is primarily intended for healthy individuals. Persons with vascular and heart diseases may use the sauna after consulting a doctor. Individuals with symptoms of acute illness, especially respiratory tract inflammation, elevated temperatures, cough, nasal congestion, diarrhea, headaches, fatigue, as well as those with open purulent or bloody wounds, and others, are not allowed to enter the sauna. Entry is also prohibited for persons with communicable diseases, carriers of bacteria, and those in the vicinity of a contagious disease. Entry is not allowed for persons under the influence of alcohol or other intoxicating substances, as well as those who are dirty. Sauna attendants are informed about the obvious signs of these diseases. A complete and specific list of sauna contraindications is always posted visibly in the wellness area. Individuals with other diseases not mentioned here or in the specific contraindication list undergo sauna use at their own risk, even if they have sought advice from a doctor.

b. Before entering the sauna, visitors must thoroughly shower and enter the sauna without swimwear, dry, and wrapped in a towel. Sitting or lying on a towel in the sauna is allowed, provided it accommodates the number of visitors.

c. Breathing through the mouth is recommended in the sauna, as high temperatures and dry air can dry the mucous membranes and cause headaches. The recommended length of stay in the sauna is 10-15 minutes, and depending on one’s condition, this procedure can be repeated several times, interrupted by showering or bathing in the cooling pool, before which it is necessary to shower.

d. Visitors must behave politely in the sauna, speak quietly, and consider other visitors.

e. In case of discomfort during a sauna visit, visitors must immediately seek the attention of the service personnel.

f. Children must not stay in the sauna cabin without adult supervision.

g. Electric devices are prohibited in the sauna.

h. Only the operator or a designated person (service personnel) is allowed to handle the equipment.

i. Qualified personnel provide sauna service and cooling pool maintenance. The water from the sauna’s cooling pool is drained daily, and the walls and bottom of the pool are mechanically cleaned, disinfected, and rinsed with clean water. If a pool with recirculation is used for body cooling, the water in the pool must be exchanged at least once a month. Water quality control is performed every six months within the scope of indicators for pools with water recirculation, as specified in Section 3.4 of this operational order. In addition, pH and free chlorine concentration are monitored and recorded daily in the cooling pool.

j. Qualified personnel are responsible for storing and cleaning linens in the wellness area. Linens are thoroughly washed and disinfected after each visitor’s use.

k. Qualified personnel perform cleaning of the wellness area multiple times a day to ensure compliance with hygiene and safe operation principles of the facilities.

3.6. Massage Services

365 Fit&Co may also provide massage services, which are exclusively carried out by individuals with professional qualifications for performing these activities. This qualification is defined as the completion of full secondary education in the field of massage or massage for the visually impaired.

3.7. Waste Collection

Waste collection is ensured through designated bins strategically placed throughout the entire 365Fit&Co premises. Waste disposal is managed by the space lessor, GALLERIA EUROVEA, which is responsible for the safe removal and handling of waste.

Article IV

Membership, Member, Membership, 365Fit&Co Membership Card

4.1 Terms such as membership, member, membership, and 365 Fit&Co membership card are defined in the General Membership Conditions of 365 Fit&Co, which are an integral part of the membership agreement.

4.2 The various types of offered memberships depend on the business strategy of the Operator. The reception and the business department of the Operator are ready to provide information on the complete offer and current prices of 365 Fit&Co services, as specified in the valid 365 Fit&Co price list on the website www.365fitco.sk.

4.3 365 Fit&Co members are required to adhere to the provisions of the membership agreement, the general membership conditions of 365 Fit&Co, and the provisions stated in this operational order.

4.4 The protection of members’ personal data is addressed in the general membership conditions of 365 Fit&Co.

4.5 Each 365 Fit&Co member will receive a membership card that allows access to and exit from 365 Fit&Co premises and the use of offered services according to the type of membership. The membership card is non-transferable and is issued for the duration of the membership agreement. After the membership expires (the membership agreement validity).

4.6 Membership does not automatically allow participation in special courses, promotions, and other events organized in 365 Fit&Co free of charge.

4.7 Membership in 365 Fit&Co is continuous, and its validity cannot be interrupted/suspended. Exceptions are cases specified in the General Membership Conditions of 365 Fit&Co.

Article V

Guidelines, Restrictions, and Prohibitions for Visitors/Members

5.1 Visitors/Members of 365 Fit&Co are entitled to use the Facilities, avail services, and purchase goods only in accordance with the provisions stated in Article VII of this operational order.

5.2 365 Fit&Co members must always identify themselves at the reception with the membership card and, upon request, with an identity document.

5.3 Facilities can only be used by individuals aged 18 and above.

5.4 An individual aged between 10 and 18 (hereinafter referred to as “Minors”) can become a Club member. The membership for Minors can be purchased by a legal representative, who concurrently signs a written consent (hereinafter referred to as “Declaration”):

  • stating that the person for whom the membership is purchased is sufficiently informed of their obligations arising from the Operational Order of 365 Fit&Co (hereinafter referred to as the “Operational Order”) and is reasonably intellectually mature to adhere to these obligations, and
  • acknowledging full responsibility for such an individual even if the legal representative does not accompany them in the premises of 365 Fit&Co. Minors (youth aged 10 to 18) may visit 365 Fit&Co exclusively based on the signed Declaration.

5.5 In the event that responsibility for a Minor is assumed within the responsibility transfer agreement, and during a lesson and course and/or personal fitness training with the fitness trainer on the premises of the Operator, this responsibility transfers upon the person’s entry into the respective Facility and its assumption by the fitness trainer. Until then, the legal representative is responsible for the movements of the Minor.

For safety reasons, entry to Facilities is not allowed for children under 10 years of age.

5.7 With the consent of the responsible person at 365 Fit&Co, a visitor – a person who is not an employee or worker of the Operator, or who is not a member – may enter 365 Fit&Co under their supervision. A visitor is a natural person who does not enter 365 Fit&Co for the purpose of availing services or purchasing goods. During their stay at 365 Fit&Co, the visitor is obliged to comply with all rules and instructions set by the Operator.

5.8 Persons not allowed to use 365 Fit&Co services include:

  • Individuals with a health condition that excludes the safe operation of sports or physically demanding activities,
  • Individuals under the influence of alcohol, any narcotic or psychotropic substances, or other addictive substances,
  • Individuals in soiled clothing, footwear, or visibly inappropriate attire causing public offense,
  • Individuals to whom the Operator has issued an entry ban.

5.9 Employees of 365 Fit&Co and individuals authorized by the Operator to ensure safety and order in 365 Fit&Co (hereinafter “personnel”) are entitled to request at any time that individuals not allowed to use 365 Fit&Co services leave. This applies to individuals whose behavior disrupts or restricts the members, other visitors, or personnel of 365 Fit&Co in their proper use.

5.10 Disruption or restriction of members, visitors, or personnel is considered verbal or physical assault on another person, rude behavior, or threats. Such behavior is considered a gross violation of the operational order. The violating member, visitor, or other person is obliged to immediately comply with the personnel’s request. Failure to do so may result in expulsion from 365 Fit&Co.

5.11 In the case of a gross violation of the operational order, the Operator has the right to prevent a member or visitor from entering 365 Fit&Co or to terminate the membership agreement, if it is concluded and valid, thereby terminating the membership agreement without entitlement to a refund of the membership fee.

Article VI

Obligations of 365 Fit&Co Members and Visitors

6.1 Members or visitors of 365 Fit&Co are obliged to:

  • Adhere to a strict no-smoking policy in 365 Fit&Co premises. Smoking in 365 Fit&Co premises is considered behavior restricting other members/visitors in their proper use.
  • Use exercise equipment, strength machines, and other 365 Fit&Co facilities only in the manner intended for them. They are obliged to behave in a way that does not lead to their damage, endangerment of their own health or the health of other members/visitors, or damage to the property of the Operator and other individuals. They are obliged to comply with hygiene rules, including the use of a towel when lying down or sitting on exercise machines and equipment.
  • Follow the instructions of 365 Fit&Co personnel.
  • Use clothing, footwear, and sports equipment and accessories suitable for the relevant sports activity during the use of 365 Fit&Co, ensuring they do not endanger their own health or the health of other members/visitors and do not pollute 365 Fit&Co premises.
  • In case of violation of any of the obligations stated in this operational order, the member or visitor is obliged to leave 365 Fit&Co premises, and the Operator may issue an entry ban.

6.2 Members/visitors are entitled to request the realization of a reservation for the desired service. The requested reservation will be implemented by 365 Fit&Co if the nature of the requested service allows it.

Article VII

Use of 365 Fit&Co Services

7.1 Members/visitors of 365 Fit&Co are entitled to use 365 Fit&Co services only if:

  • They are members of 365 Fit&Co with valid membership, or
  • They are guests of a 365 Fit&Co member and are registered at the 365 Fit&Co reception, having agreed to this operational order during registration and the use of 365 Fit&Co services complies with the member’s membership, or
  • They have a one-time entry to 365 Fit&Co registered at the 365 Fit&Co reception, subject to the fees specified in the valid 365 Fit&Co price list, and have agreed to this operational order during registration,
  • They hold a Multisport or UpBalansea card, and their Multisport card has been scanned at the 365 Fit&Co reception before entry,
  • They are paying visitors to a one-time event or activity organized or co-organized by 365 Fit&Co.

7.2 The payment of the price for the provided services and goods according to the 365 Fit&Co price list is made before leaving 365 Fit&Co:

  • By cash payment at the reception or an equivalent that 365 Fit&Co accepts (hereinafter “cash payment”),
  • By payment card accepted by 365 Fit&Co,
  • By debiting the account of the membership card holder, with the card having sufficient credit to cover their bill. If the credit balance on the membership card is less than the bill, the cardholder is obliged to pay the difference in cash or by payment card at the reception on the same day.

7.3 The owner of the membership card is also entitled to recharge the membership card with additional credit.

Article VIII

General Conditions of Stay at 365 Fit&Co

8.1 Movement within 365 Fit&Co premises requires the use of an activated membership card. Every consumption by a member or client/visitor, as well as services ordered beyond those included in the membership, is recorded on the membership card.

8.2 The final payment for purchased services and goods in 365 Fit&Co is made upon departure from 365 Fit&Co. When paying in cash, the member or client/visitor should always check the change after payment. Later complaints will not be accepted.

8.3 Members or visitors using account payment, who do not have a sufficient balance in their account, will settle the difference in cash at the reception on the same day. A member/visitor is allowed to make a cash payment for services and products purchased at 365 Fit&Co. If a member forgets their membership card, they are allowed to use the services if they can prove their identity to the reception staff with a valid ID to verify their details and issue a replacement card if necessary. The issuance of a replacement card may be subject to a fee according to the 365 Fit&Co price list.

8.4 Lockers are provided for storing belongings in changing rooms. The lock operates on a PIN code, and the client is familiarized with its operation during their first visit to the fitness center.

8.5 The Operator is only responsible for damage to items placed in designated areas in accordance with Article X of this operational order.

8.6 If a member or visitor does not have a locker rented from the Operator, they are obliged to empty the locker each time they leave and leave it unlocked.

8.7 If a member or visitor does not empty the locker according to point 8.6 of this article, the Operator has the right to forcibly open lockers that remain locked after the operational period or after the rental period. The Operator is not liable for any damage or loss caused by the breach of the obligation to leave the locker empty and unlocked.

8.8 The Operator undertakes to store items found in forcibly opened lockers for a minimum of 14 (fourteen) days. When handing over such items, the Operator will charge the member or visitor a one-time handling fee of EUR 20.00 (in words: twenty euros).

Article IX

Multisport Card Holders

9.1 Holders of the Multisport card are entitled to use the following services at 365 Fit&Co: fitness, wellness, group exercises, and boot camp.

9.2 A Multisport cardholder can use only one of the mentioned services per day, up to a maximum of 1 time.

9.3 When using wellness, the following restrictions apply:

  • The stay in the wellness area is limited to a maximum of 60 minutes.
  • Wellness can be accessed with the Multisport card between 8:00 and 22:00.
  • The total wellness stay is limited to 80 minutes, and exceeding the limit incurs a cancellation fee of 10 EUR.

9.4 When using the fitness area, the following restrictions apply:

  • The stay in the fitness area is limited on certain days and times.
  • From Monday to Thursday (inclusive), a reservation must be made between 16:00 and 20:00. During these times, there is a time limit of 100 minutes, starting from entry into the fitness center, and the visit concludes by leaving the premises of 365 Fit&Co, passing through the turnstile at the 365 Fit&Co reception. Exceeding the time limit incurs a cancellation fee of 10 EUR.

9.5 When participating in group exercises and boot camp:

  • The stay in the premises of 365 Fit&Co for these two services is limited to 100 minutes. The visit starts from entry through the turnstile at the 365 Fit&Co reception and concludes by leaving the premises of 365 Fit&Co, passing through the turnstile at the 365 Fit&Co reception. Exceeding the time limit incurs a cancellation fee of 10 EUR.

Article X

Special Events and Activities

10.1 Special events refer to extraordinary, usually one-time, pre-announced sports events providing services of a specific nature, with a limited scope, a limited number of participants, and a fixed price. Admission must be paid in advance and is non-refundable. Operation limitations related to the organization of special events will be announced in advance through posters placed in the premises of 365 Fit&Co and on the website www.fitco.sk.

10.2 If a visitor presents a medical certificate stating that they are not medically fit to participate in a special event, submitted at least 1 day in advance, they may offer already purchased tickets at the 365 Fit&Co reception for resale. There is no legal right to sell tickets.

Article XI

Liability

11.1 The member/visitor of 365 Fit&Co is obliged to conduct themselves in the facilities in a manner that does not disturb the comfort of other members or visitors, avoids causing harm to health and property, and does not interfere with the work duties of the employees of 365 Fit&Co or its personnel.

11.2 The member or visitor of 365 Fit&Co is responsible for any damage caused to 365 Fit&Co, including the loss of borrowed sports equipment, sportswear, footwear, towels, keys, and similar items.

11.3 If, by their actions, which violate their above-mentioned obligation or any other legal obligation, a member or visitor causes damage, they are fully responsible for it in accordance with the provision of § 420 of Act No. 40/1964 Coll. (Civil Code) as amended.

Operator’s Liability for Damage to Brought or Stored Items:

11.5 For valuable items properly stored in lockable lockers, for which the member/visitor has keys/locks according to the instructions, the operator is responsible up to the amount of EUR 332. Valuable items include mobile phones, cameras, jewelry, etc. Any damage to a locker and the loss of personal items stored in it must be reported promptly to the responsible employee of 365 Fit&Co.

11.6 Lockers in changing rooms are not intended for storing jewelry, cash, mobile phones, notebooks, and other valuables.

11.7 The right to compensation for damage must be asserted by the member or visitor against the operator without undue delay. The right expires if it has not been asserted no later than fifteen days after the day the injured party learned of the damage.

Liability for Defects in Goods:

11.8 If goods purchased from the operator have defects, the member or visitor is entitled to report these defects in the warranty process with the operator. Defects are reported at the reception of 365 Fit&Co. In the case of a complaint, the member or visitor must present a proof of purchase for the goods.

Liability for Other Damage:

11.9 Liability for other damage is governed by the provisions of § 420 and following of Act No. 40/1964 Coll. (Civil Code) as amended.

Liability for Misuse of the Membership Card:

11.10 In case of card loss, the member is obliged to report this fact promptly to 365 Fit&Co and request the card to be blocked. Until the permanent card is blocked, the Operator is not responsible for its misuse by a third party.

Article XII

Method and Frequency of Cleaning 365 Fit&Co Premises

12.1 Disinfection of surfaces as well as wet mechanical cleaning of floors and personal hygiene facilities in 365 Fit&Co is carried out during the night and throughout the day as needed.

12.2 Waste containers in the facility are emptied throughout the day as needed.

12.3 Lighting fixtures and windows are protected from breakage by a sufficient distance from members and visitors or from machines and equipment, and are cleaned as needed.

12.4 Disinfection, cleaning, tidying up, as well as all activities related to cleanliness and order in 365 Fit&Co, are the responsibility of the company that performs these activities based on a contractual relationship with the operator. As of the date of issuance of this operational order, cleaning services are provided by the company GEMINI – cleaning services, address: Kutlíkova 8, Bratislava, ID: 45319537, responsible person: Kristína Halásová, contact number: 0902 251 765.

Article XIII

Final Provisions

13.1 The Operator is authorized to change or supplement the provisions of the operational order and General Membership Conditions at 365 Fit&Co based on changes in the operation, the requirements of 365 Fit&Co members, and feedback from 365 Fit&Co members. The change or addition to the operational order and General Membership Conditions at 365 Fit&Co is effective against members and other visitors to 365 Fit&Co on the day of their publication in the premises of 365 Fit&Co and on the website www.365fitco.sk. Members and visitors of 365 Fit&Co are obliged to familiarize themselves with the changes or additions to the operational order and General Membership Conditions at 365 Fit&Co.

13.2 The Operator is authorized to further adjust the individual rights and obligations of the Operator, members, and visitors in specific operations.

13.3 Specific rules for the Wellness Operation are regulated in Annex No. 1.

13.4 Specific rules for the Body&Mind Operation are regulated in Annex No. 2.

13.5 Specific rules for the Fitness&Cardio Operation are regulated in Annex No. 3.

Specific Rules for the Wellness Operation

General Rules

1.1 Specific operational rules are, in accordance with Article XII, point 12.3, an addition to the operational order. The client of 365 Fit&Co is obligated to behave in the operation in a way that does not disturb the comfort of other members, avoids causing harm to health and property, and does not interfere with the work duties of 365 Fit&Co employees and staff.

1.2 Operating hours are clearly marked. No person is allowed to enter the operation outside of operating hours.

1.3 Type and manner of providing Wellness services: Finnish sauna, sanarium, steam cabin, spatial ice generator, Kneipp path, cooling pool for 365 Fit&Co members.

Health Contraindications of Services, Prohibitions Applicable in the Wellness Operation

2.1 The visit to the Wellness Operation is primarily intended for healthy individuals. The visit to the Wellness Operation is not recommended for individuals suffering from vascular and heart diseases, inflammatory diseases of internal organs, and respiratory system diseases. The visit to wellness is also not recommended for individuals suffering from psychoses, claustrophobia.

Prohibition of Entry into the Wellness Operation Applies to:

a) Individuals under the influence of alcohol, toxic substances, or other addictive substances, b) Individuals with animals, c) Individuals suffering from communicable infectious diseases (in case of doubt, the member may be asked for confirmation from a doctor) or individuals with open injuries, skin problems, or suffering from any disease endangering the health of other members, d) Individuals intending to use 365 Fit&Co for commercial or non-standard use without the permission of 365 Fit&Co management, e) Dirty individuals, in contaminated clothing, f) Children under 12 years of age.

2.1.1 For safety reasons, individuals who cannot move or dress and undress independently without the assistance of another person, as well as individuals with significant physical or mental disabilities, are allowed entry to the Wellness Operation only with an accompanying person.

2.1.2 Children older than 12 years and younger than 15 years (children who have reached the age of 15 must, upon request of the Club’s staff, present an identity card) are allowed entry only accompanied by a person older than 18 years and until 8:00 PM.

In the Wellness Operation, it is prohibited to:

  • Smoke,
  • Bring in and use glass objects (including bottles),
  • Photograph or film individuals or groups without their consent (permission from the management of 365 Fit&Co is required for photography and filming for commercial purposes),
  • Engage in any erotic or sexual behavior,
  • Create excessive noise and restrict the comfort of other visitors with behavior,
  • Run (which poses a risk of injury due to slipping),
  • Use sports and gaming equipment (including whirlpool, pool, and saunas),
  • Use shampoos, body preparations, or other toiletries outside of the showers,
  • Use shaving products,
  • Enter with chewing gum and consume any food,
  • Read magazines, newspapers, books, etc., in the sauna and whirlpool areas,
  • Interfere with technical equipment and facilities and pass through turnstiles to areas outside,
  • Request services from the staff that contradict the operational order.

Operational Instructions for Visitors 4.1 The member/visitor is required to shower before entering the Wellness Operation.

4.2 The member/visitor must leave the Wellness Operation premises no later than 15 minutes before the end of the operating hours.

4.3 The member/visitor is required to maintain cleanliness and hygiene in the Wellness Operation premises, handle the equipment of the Operation with care, and not damage the Wellness Operation areas.

4.4 The member/visitor is required to inform the staff immediately in case of discovered and sudden health problems.

4.5 In case of technical reasons, the Operator reserves the right to adjust the operating hours for safety reasons. In the event of the above circumstances, the Operator is not obliged to refund the entrance fee or compensate the member/visitor in any other way.

4.6 The Operator is not responsible for injuries and accidents caused by the visitor/member’s own carelessness or non-compliance with the operational order or these Specific Rules.

5. Responsibility, Safety Principles, and Health Protection

Members/visitors use the Wellness Operation at their own risk.

A first aid kit, equipped in accordance with the decree of the Ministry of Health of the Slovak Republic No. 554/2007 on the details of requirements for facilities caring for the human body in force, is placed in a suitable and accessible location in the Wellness Operation.

In the event of injury to staff or a member/visitor, the affected area must be rinsed with water and subsequently disinfected. In the case of contamination of hands with biological material, hands must be washed and disinfected with a preparation with bactericidal and virucidal effects, such as Sanytol disinfectant gel.

Surfaces and devices contaminated with biological material must be disinfected with a preparation with a broad-spectrum microbicidal effect, such as Savo disinfectant, before cleaning.

The Wellness Operation is equipped with an adequate amount of cleaning and disinfecting agents, as well as clean linens. Only medically harmless products from the distribution network (aromas for saunas, etc.) are allowed to be used.

Staff must have personal protective equipment available according to the type of activities performed, primarily work clothes and work shoes.

All sauna areas, items, and equipment are regularly maintained in cleanliness. All sauna areas must be washed with water and a cleaning agent, scrubbed with a brush, and disinfected with a disinfectant at least once a day. Toilet paper, liquid soap, and paper towels are replenished daily (unless warm air hand dryers are installed).

The water from the cooling pool (if present in operation) must be drained daily after operation. The walls and bottom of the pool must be mechanically cleaned and disinfected with a disinfectant solution, followed by proper rinsing with clean water. If a pool with water recirculation is used, the water in the pool must be changed at least once a month.

Water quality is checked every 6 months within the scope of indicators for pools with water recirculation set out in the decree of the Ministry of Health of the Slovak Republic No. 72/2008 on details of requirements for the quality of swimming pool water, bathing water, its control, and swimming pools. Laboratory testing is provided by the Regional Public Health Authority of the capital city of Slovakia, Bratislava.

The facility must have an adequate amount of linens, suitable for the expected number of visitors/members. Clean linens must be used for each visitor/member. When handling linens, there must be no mutual contact or interchange between clean linens and used linens.

Exceptions 5.1 The Operator reserves the right to grant exceptions from the operational order and the Specific Rules of the Wellness Operation.

Annex No. 2

Specific Rules for Body&Mind Operation

General Rules 1.1 Specific operational rules are in accordance with Article XII, Section 12.4, as a supplement to the operational regulations. Clients of 365 Fit&Co are obliged to behave in the Operation in a way that does not disturb the comfort of other members, avoids causing harm to health and property, and does not disrupt the work duties of 365 Fit&Co staff and personnel.

Operating hours are clearly marked. No person is authorized to enter the Operation outside of operating hours.

1.3 Entry is allowed only after the Operation is opened and under the supervision of the fitness trainer on duty.

Prohibitions Applying to Body&Mind Operation 2.1 The prohibition of entry into the Body&Mind Operation applies to:

  • Individuals under the influence of alcohol, toxic substances, or other addictive substances,
  • Individuals with animals,
  • Individuals suffering from communicable infectious diseases (in case of doubt, the client may be asked to provide confirmation from a doctor) or individuals with open injuries, skin problems, or any illness endangering the health of other visitors,
  • Individuals intending to use the Club for commercial or non-standard use without the permission of the management of 365 Fit&Co,
  • Individuals in dirty, contaminated clothing and footwear.

2.1.1 Minors are allowed entry only under the conditions specified in the general membership terms of Fit&Co.

2.2 In the Body&Mind Operation, the following are prohibited:

  • Smoking,
  • Bringing in and using glass objects (including bottles),
  • Photographing or filming individuals or groups without their consent (permission from Fit&Co management is required for photography and filming for commercial purposes and printing),
  • Restricting the comfort of other clients and not disrupting the course of the lesson with behavior,
  • Consuming any foods and dishes,
  • Interfering with the technical equipment of the halls (air conditioning, sound, lighting),
  • Walking outside the turnstiles,
  • Requesting services from the staff that contradict the operational regulations.

3.1 Members/visitors are required to use clean and appropriate sports footwear.

3.2 Members/visitors are required to use a towel.

3.3 Members/visitors are obliged to follow the instructor’s instructions.

3.4 Members/visitors are required to maintain cleanliness and hygiene in the operation’s halls.

3.5 Members/visitors are required to store used equipment in its designated place after the lesson (do not remove equipment from the operation’s halls).

3.6 Members/visitors are required to promptly inform the instructor in case of identified and sudden health problems.

3.7 Members/visitors are required to handle the club’s equipment with care and not damage the spaces of 365 Fit&Co.

3.8 In the event of technical reasons, the operator reserves the right to adjust the operating hours for safety reasons. In the case of the above-mentioned circumstances, the operator is not obliged to refund the entrance fee or compensate the member/visitor in any other way.

3.9 The operator is not responsible for injuries and accidents caused by the member/visitor’s own carelessness or failure to adhere to the operating regulations or these specific rules.

Responsibility Members/visitors use the Body&Mind Operation at their own risk.

Exceptions 5.1 The operator reserves the right to grant exceptions from the operating regulations and the specific rules of the Body&Mind Operation.

Appendix No. 3

Specific Rules for Fitness&Cardio Operation

General Rules 1.1 Specific operation rules are in accordance with Article XII, point 12.5, as a supplement to the operational order. Clients of 365 Fit&Co are obliged to behave in the operation in a way that does not disturb the comfort of other members, avoids harm to health and property, and does not disrupt the work duties of 365 Fit&Co employees and staff.

1.2 Operating hours are visibly marked. No person is allowed to enter the facility outside operating hours. Entry is allowed only after the opening of the operation and under the supervision of the fitness trainer on duty.

Prohibitions Applicable to Fitness&Cardio Operation 2.1 Entry into Fitness&Cardio Operation is prohibited for:

  • Individuals under the influence of alcohol, toxic substances, or other addictive substances,
  • Individuals with animals,
  • Individuals suffering from communicable diseases (in case of doubt, the client may be asked for confirmation from a doctor) or individuals with open wounds, skin problems, or any illness endangering the health of other clients,
  • Individuals intending to use the club for commercial or non-standard use without permission from 365 Fit&Co management,
  • Individuals in dirty or contaminated clothing.

  • Interfere with the technical equipment of the hall (air conditioning, sound system, lighting),
  • Move beyond the turnstiles,
  • Request services from the staff that contradict the operational order.

3.3 Members/visitors are obliged to follow the instructions of the instructor and trainer.

3.5 Members/visitors are obliged to store used equipment in its designated place after exercising (do not remove equipment from the operation’s halls).

3.6 Members/visitors are obliged to use a disinfectant – aerobic machines after exercising.

3.7 Members/visitors are obliged to handle the equipment of the operation with care and not damage the spaces of the operation.

3.8 Members/visitors are obliged to promptly inform the fitness trainer or staff in case of identified and sudden health problems.

3.9 In case of technical reasons, the operator reserves the right to adjust the operating hours for safety reasons. In the event of the above-mentioned circumstances, the operator is not obliged to refund the entrance fee or compensate the member/visitor in any other way.

3.10 The operator is not responsible for injuries and accidents caused by the member/visitor’s own carelessness or failure to adhere to the operating regulations or these specific rules.
